3. Estimates and Quotes Disclaimer
Any cost estimates, project ranges, pricing information, or budget guidance provided on this Site are for general informational purposes only and do not constitute a binding offer, contract, or guarantee of price. All construction and remodeling projects require an on-site consultation, written scope of work, and a signed written contract before any work commences. In accordance with the Florida Deceptive and Unfair Trade Practices Act (FDUTPA, Fla. Stat. § 501.201 et seq.), NG Home Builders does not engage in deceptive pricing practices, and all final pricing will be clearly stated in your written contract.
4. No Warranty — Website Content
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. All project warranties are governed exclusively by the written contract executed between NG Home Builders and the client.
5. Florida Construction Lien Notice
Pursuant to the Florida Construction Lien Law (Fla. Stat. Chapter 713), NG Home Builders and its subcontractors, sub-subcontractors, materialmen, and laborers may have lien rights on your property for labor, services, or materials furnished in connection with any construction or improvement project. Failure to pay amounts owed under a written contract may result in the filing of a construction lien against your property. We encourage all clients to review their rights and responsibilities under Florida's Construction Lien Law prior to entering into any construction contract.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, NG HOME BUILDERS, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THIS SITE OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THIS SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00). This limitation does not apply to liability arising from our gross negligence or willful misconduct, or to any claims that cannot be limited under applicable Florida law.
